What is an Employment Related Grievance?

A staff member may feel that he or she has a grievance arising out of unfavourable treatment or decisions which adversely affect her/him in her/his capacity as a member of staff of the university.

The Employment Related Grievance Procedure applies to all staff as detailed under the Enterprise Agreement (Academic and Professional Staff) 2009.

Employment Related Grievance Procedures also applies to all Trades & Services Staff via policy.

What is not an Employment Related Grievance?

Appeals against disciplinary action, appointment, probation, classification or promotion, sexual harassment or discrimination, and/or action arising under the Accident Compensation Act 1985 are expressly excluded from the operation of the grievance resolution procedure.

A decision or failure to make a decision or any other matter arising under clause 17 - Continuing (Contingent Funded) Employment is also excluded from the operation of the grievance resolution procedure.

If a staff member is unsure which procedure to use he or she should contact an Grievance Adviser for advice on the appropriate procedure.

What happens if I want to pursue a grievance?

It is expected that in most situations the staff member will first discuss the grievance with his/her supervisor. A staff member may contact an Adviser or a Representative at any stage of the grievance procedure for advice on how to deal with the grievance.

Grievance advisers may be contacted by phone or by email.

If I seek advice will the conversation be confidential?

All grievance advisers have been trained to adhere to all relevant Monash policies and procedures including confidentiality and privacy policies. The Adviser will not discuss the content of the grievance with any person other than the staff member in any way which could lead to the identification of the staff member without the prior express authority of the staff member. However, in certain cases when a staff member discloses a criminal act or where the Adviser believes that an individual is at risk of causing harm to themselves or others, the details of the grievance must be reported to the relevant internal and external bodies.
